Hi, I am looking for support on the below issue and am hoping you can share with other members!

After a complaint to the village concerning noise and light emitted from a general industrial zoned facility that shares a residential property line with me, (ALL Color) the village staff is now seeking to change wording of two sections of ordnances which would allow compliance rather than enforcing compliance. These changes will first be brought to the Planning Commission on February 1st. These changes were first considered after the village administrator spoke personally with the business owner. This business owner has personal and financial ties to the village, the Governor’s office, as well as sitting on the board of the Oregon Community Bank. These facts, to me make the motivation of the proposed changes by the village staff questionable and troubling in nature.

If these proposed changes occur it will allow all like zoned properties to keep overhead doors and windows open at all hours day and night regardless of objectionable noise and light coming from these facilities. Currently at this facility, six open overhead doors allowing objection shill intermittent noise continues from 6AM until 11PM sometimes midnight on weekdays, spring through fall. Doors are kept closed during the winter months which eliminates most noise problems. The noises that have been deemed allowable by the village staff include continuous forklift back-up alarms, radio, and loud hum of exhaust fans. The lighting which has been deemed allowable include flashing red and green dock lights aimed directly at a residential a property. This goes on day and night.

Noise, light, and non- enclosed facility complaints were tested and mostly dismissed as fitting within the performance standards of the village. The issues which were not dismissed are the issues being proposed for change by the village staff on behalf of the business owner. (The fact village staff is willing to advocate for this business but not for me is confounding.) When asked for a copy of the report showing methodology used for these tests I was told the report is not finished and not available at this time which I found odd considering a determination was already made regarding many points of my complaint. It is my position that this testing was considerably flawed in relation to the prescribed ordinance testing methodology as I was able to question the zoning administrator regarding his approach prior the day of the testing. It almost seems determinations were made prior to testing.

In closing, changing ordnances to benefit one business owner (forcing him to close his doors would mean adding proper cooling and ventilation systems due to a heat intensive operation) while negatively impacting the quality of life and property value of a resident should not be the manor of governance in our village. These proposed changes are not for the greater good by any means. I am asking you to please consider contacting Village board members asking them not to allow changes to the noise and usage ordnances for general industrial zoning to first be discussed February 1st at the planning commission meeting.
